On January 6th, 2021, during the finalization of the Electoral College vote of the 2020 United States presidential election, Donald Trump held a rally outside the White House at the Ellipse. This rally would then turn into a protest against the vote outside Capitol Hill in D.C., based around claimed voter fraud in the 2020 United States presidential election,(C-SPAN [3:33:05]) and it would become a violent riot, threatening the lives of lawmakers finalizing the vote, including Mike Pence,(January 6th Committee, p. 89) ((January 6th Committee [14:47]) (DoJ, p. 40) stalling the vote for a few hours.(MSNBC) (NPR, Lonsdorf, Dorning, et al.) Rudy Giuliani starts out the speech by explaining that there are two points in their speech together.(C-SPAN [2:19:10])

  • Whatever they’re doing for the “plan today” is “perfectly legal.”(C-SPAN [2:19:23]) This is because of the “questionable constitutionality of the Election Counting Act of 1887”.(C-SPAN [2:19:45]) Because of this, “the Vice President can cast it aside and he can do — a president called Jefferson did when he was Vice President.”(C-SPAN [2:19:55])
  • He references Jefferson as an example of a vice president changing the outcome of an election for president, however, this was done before the Electoral Count Act was passed, which he already says has “questionable constitutionality.”(C-SPAN [2:19:45])
  • He also states that states “want” to change the outcome of the election from five “letters” that have been sent “begging” then to do that.(C-SPAN [2:20:25]) He is either lying since these were never sent by any official in the state governments or they are referencing the false elector scheme.
  • He states “who hides evidence, criminals hide evidence,” but ballots have historically been kept secret from the public and other non-authorized government officials due to the privacy concerns of voters.(C-SPAN [2:21:30])

In this speech, he pressures Republicans in Congress to challenge the vote certification, Mike Pence to refuse to certify the vote, and reiterates tons of different false election fraud allegations and riles the crowd up to “fight like hell” or else they’re not going to have a country anymore.

Nancy Pelosi’s role in January 6th

A few videos and quotes have been reported made by Nancy Pelosi of her claiming to take “responsibility” for the lack of preparation and defense of the Capitol on January 6th, with her saying in a bunker, “We have totally failed. We have to take some responsibility for not holding the security accountable for what could have happened.”(House Committee [6:49])

Another video shows her saying something similar in a car, recorded by her own daughter, saying, “We did not have any accountability for what was going on there … and we should have.” She also said, “Why weren’t the National Guard there to begin with … I take responsibility for not having them just prepare for more”(CBS6, Gaskins)

Despite her taking responsibility, however, there was little she could have done to prevent or stop the riot than unfolded on January 6th.

Supposed Lies

Various online news websites would claim that Hutchinson was lying due to several inconsistencies within her testimony. The Gateway Pundit, for instance, would either talk about unnecessary bits to the overall point of Hutchinson’s testimony or are simply incorrect.

Steering wheel testimony

Cassidy Hutchinson was accused of lying about Donald Trump trying to grab a steering wheel from the Secret Service driver during their drive back to the White House.(Gateway Pundit, Wetmore) However, the article leaves out that she was recalling the even from a second or even thirdhand perspective from Tony Ornato, a former Secret Service agent who served as Trump’s deputy chief of staff at the time, and was not actually there during the events which she described. Other witnesses who spoke with the committee, one’s who did and didn’t testify, although disagreeing with her about Trump’s motion to grab the steering wheel, agreed with everything else she had to say about the encounter with Donald Trump in the vehicle, including his hostility with the idea of not being able to go to the Capitol building.(New York Times, Broadwater) (THE HILL, Beitsch)

The Gateway Pundit also claims double hearsay when she recalls this story from Tony Ornato. While it is true that using stories like this as evidence of a crime is generally invalid in court, Hutchinson’s general claim throughout her testimony was not that Trump tried to grab a steering wheel out of anger, her general claim throughout her testimony was that Trump had plans to steal the election from Joe Biden and knew he lost. Extra testimony like this therefore cannot reasonably be used to counteract the rest of her hours of testimony to the committee.

The Gateway Pundit shows quotes from interviews from the committee from the people that Hutchinson is referring to in her testimony saying they don’t recall the story she cited.(Gateway Pundit, Wetmore) However, this isn’t enough to prove she was lying and could simply mean that she either misremembered the event or they did.(New York Times, Haberman)

First “Lie”

The Presidential SUV does in fact go by “The Beast,” going as far back as 2011.(Business Insider, Allison Churchill and Robert Johnson) (MotorTrend) Even if this fact was wrong, it would not be difficult to mix two black vehicles that the president would use to get around, since they normally use “The Beast” to get around.

Second “Lie”

Cassiday Hutchinson [sic] said President Trump grabbed the neck area of Secret Service agent Bobby Engel.(Gateway Pundit, Hoft)

This claim has no real source, and the source given for the claim links to a post with no mention of someone grabbing someone else’s neck.
Cassidy Hutchinson does mention, notably in a source not mentioned by the Gateway Pundit,(Gateway Pundit, Hoft) that Trump tried grabbing him around his neck area, but he never actually had his hand on his neck, with only an implication.(Twitter, AP News)

Third “Lie”

Cassidy Hutchinson said President Trump broke dishes and flipped tablecloths on January 6th.(Gateway Pundit, Hoft)

The only evidence against this claim comes from Trump’s Truth Social posts.(AP News, Merchant, Tucker) Trump himself would disagree with the allegations made against him here, but there has yet to be any contradictory testimony on this subject, and Trump being the accused would object to these allegations.

Fourth “Lie”

Cassidy Hutchinson claimed to have written a handwritten note on January 6th.(Gateway Pundit, Hoft)

This claim does have some truth to it, since Eric Herschmann did also testify that he did in fact write the note despite Hutchinson’s testimony.(Gateway Pundit, Robison) However, it is also likely that they simply misremembered who wrote it or that they have similar handwriting. Regardless of who wrote it, similar to many of the alleged lies made by Hutchinson, they don’t affect the central point of the claims, since both Herschmann and Hutchinson agree that the note was to make Trump take action on January 6th at around 3 p.m.(January 6th Committee, Herschmann Testimony, pp. 66-69)

Fifth, sixth, and seventh “lies”

Cassidy Hutchinson said her boss Mark Meadows called Roger Stone on January 5th to find out what would play out the next day on January 6th.(Gateway Pundit, Hoft)

Similar to the other alleged lies made here, the evidence for the lie comes from someone who did not testify against her or on contradiction to what she said.(Gateway Pundit, Hoft) The person who claims that she was lying was Michael Flynn, who was previously found guilty for lying to the FBI,(Casetext) so it’s very unlikely that he was in fact correct in this scenario.

Similar to the previous “lie,” this was written in the same article.(Gateway Pundit, Hoft) Instead of Michael Flynn, this is Roger Stone saying he never communicated with Mark Meadows in this context. Again, Stone never testified to any official body any contradictory claims and as also been convicted of lying, this time to Congress during the First Trump Administration.(DoJ)

Cassidy Hutchinson testified that Trump’s White House counsel Pat Cipollone was at the White House on the morning of January 6, 2021.(Gateway Pundit, Hoft)

This allegation is another one of the strongest ones made that Hutchinson lied. However, this has a same problem as the other ones, it’s statements made without being under oath or under testimony. Not only that, but the people who did give statements against Hutchinson were anonymous to the Federalist. This doesn’t necessarily make their claims false or misleading, but it simply isn’t enough evidence to prove that Hutchinson was wrong, let alone lying.(Federalist, Justice)

He had a meeting with him on December 1st, next on the day after on December 2nd, and his final one with him on December 14th. Richard Donoghue would testify that every claim Donald Trump made from the election about voter fraud was unsubstantiated and false.(January 6th Committee, Donoghue’s Testimony, p. 58) In one meeting in particular, Donald Trump would ask Donoghue to make a public statement, saying that the election was filled with fraud that might’ve caused Donald Trump to in fact beat Joe Biden. Donoghue responded with a resounding no, due to the investigations by the Department of Justice finding no wrong-doing. When Trump heard this, he responded with the following:

Richard Donoghue He says, "I don't expect you to do that. Just say that the election was corrupt and leave the rest to me and the Republican Congressmen." [. . .] So I put it in quotes. It is an exact quote from the President.(January 6th Committee, Donoghue's Testimony, p. 58)

Due to this conflict, Donald Trump would ask Jeff Clark if he would like to be the new Acting Attorney General, since Clark was supportive of Trump’s idea that Donoghue originally rejected.(January 6th Committee, Donoghue’s Testimony, p. 124)
Later on, Donald Trump would set up a meeting to accomplish this with Pat Cipollone (White House Counsel), Steven Engel (United States Assistant Attorney General), Jeff Clark (Assistant Attorney General for the Environment and Natural Resources Division), Richard Donoghue (Acting United States Deputy Attorney General), Jeff Rosen Acting United States Attorney General), Eric Herschmann (Senior Advisor to the President), and Pat Philbin (Deputy White House Counsel).(January 6th Committee, Donoghue’s Testimony, p. 122) During this meeting, Donoghue, along with everyone else during the meeting except for Clark and Trump, would not only oppose the idea of making Clark the new Acting Attorney General, but would resign if it was done.

And then — and I said something to the effect of, “You’re going to have a huge personnel blowout within hours, because you’re going to have all kinds of problems with resignations and other issues, and that’s not going to be in anyone’s interest.” And so the President said, “Well, suppose I do this” — I was sitting directly in front of the President. Jeff Rosen was to my right; Jeff Clark was to my left. The President said, “Suppose I do this, suppose I replace him,” Jeff Rosen, “with him,” Jeff Clark, “what do you do?” And I said, “Sir, I would resign immediately. There is no way I’m serving minute under this guy,” Jeff Clark. Christopher C. Miller would testify to having two meetings with Donald Trump in the upcoming days of January 6th, one on the third, and one very brief one on the fifth. In the first meeting here, Miller would be accompanied by General Milley,(January 6th Committee, Miller’s Testimony p. 95) (January 6th Committee, Miller’s Testimony p. 96) and it was primarily to discuss a national security threat by an unnamed foreign power, and he would say he cannot comment on the particulars of the foreign power or security threat in question.(January 6th Committee, Miller’s Testimony p. 96)

He did, however, clarify that the meeting was not for the purposes of January 6th. Despite this, January 6th did come up at the end of the meeting discussing the potential crowd size.(January 6th Committee, Miller’s Testimony p. 97) Towards the end, in a 30-60 second conversation, where Trump would briefly mention something along the lines of “give them what they need” in a passing comment,(January 6th Committee, Miller’s Testimony p. 98) Miller would respond by saying that they “had a request for support from Mayor Bower that we would fulfill.” This was all that was discussed about January 6th at this meeting.(January 6th Committee, Miller’s Testimony p. 98)

In the second meeting on January 5th, which would last not so long,(January 6th Committee, Miller’s Testimony p. 97) likely around 30 seconds,(January 6th Committee, Miller’s Testimony p. 99) Trump would mention to Miller “they were going to need 10,000 troops the following day,” with “they” referring to law enforcement, public security, and public safety.(January 6th Committee, Miller’s Testimony p. 99) Miller would interpret this brief comment as “presidential banter,“(January 6th Committee, Miller’s Testimony p. 99) and would take no action into deploying 10,000 active National Guard troops.(January 6th Committee, Miller’s Testimony p. 99) (January 6th Committee, Miller’s Testimony pp. 100-101) His reasoning would not just because of his interpretation of Trump’s casual comment, but also since he’s heard that “domestic law enforcement entities had stated earlier that they could handle much — you know, a million people.”(January 6th Committee, Miller’s Testimony p. 100) He would go on to reaffirm that the President, Donald Trump, could at any moment without any other authority confirmation, deploy forces as the Commander in Chief.(January 6th Committee, Miller’s Testimony p. 102)

Miller would go on to say that the cause for the delay in deploying the National Guard at the Capitol was due to a miscommunication between himself and McCarthy.(January 6th Committee, Miller’s Testimony p. 117)

What I’m saying is that it appears that McCarthy interpreted the guidance and the order at 3:04 differently than I relayed it, which I think is completely acceptable based on the chaos that’s going on and not to be pedantic, but I will.(January 6th Committee, Miller’s Testimony p. 117)

Gregory Jacob would testify to witnessing alternate slates of electors being submitted that were not approved by any State authority on or around January 2nd.(January 6th Committee, Jacob’s Deposition, p. 61) January 4th would be the first time he would hear John Eastman, Donald Trump’s personal lawyer who helped craft the false elector scheme and the memos along with it, mention anything about the false elector scheme.(January 6th Committee, Jacob’s Deposition, p. 97) On January 5th, John Eastman would admit to Jacob that you would have to “set aside” the Electoral Count Act,(January 6th Committee, Jacob’s Deposition, p. 96) and “violate” it,(January 6th Committee, Jacob’s Deposition, p. 130) which would only be possible by breaking that law. He would also repeat the ideas of voting machines being rigged to Jacob on January 5th, which Jacob would disagree with.(January 6th Committee, Jacob’s Deposition, p. 131)

Jacob would also go into detail about his arguments with Eastman about the Electoral Count Act and how he thinks the false elector scheme would be wrong on a legal basis.(January 6th Committee, Jacob’s Deposition, p. 130-134) One of Eastman’s arguments was that Lincoln suspended the writ of habeas corpus due to an emergency and that this case would be similar. (January 6th Committee, Jacob’s Deposition, p. 123)
Eastman would mention getting letters from State legislators saying they wanted to change the outcome of the election, which Jacob would say never happened and that the State legislators never wanted to do this. Eastman’s response was that they would “try to get some letters.”(January 6th Committee, Jacob’s Deposition, pp. 123-124)
During the arguments, Jacob would claim that Eastman acknowledged that the Supreme Court would likely rule 9-0 against his legal theory surrounding the Electoral Count Act and the Vice President’s role in the counting of electoral votes.(January 6th Committee, Jacob’s Deposition, p. 117) However, he hoped that the Supreme Court would not get involved with the Electoral Count Act issue because he thought the courts would think it’s a “political question,“(January 6th Committee, Jacob’s Deposition, p. 111) and Eastman would never answer what would happen after that to Jacob.(January 6th Committee, Jacob’s Deposition, p. 112) It’s likely that because the courts would not touch the case, it would allow Mike Pence to have much more room to enact the false elector scheme.

Jacob would end his testimony with some events on January 6th. At around 2:13 p.m., the Senate’s debate immediately stopped, and at 2:22 p.m., Mike Pence would be evacuated to a secure location.(January 6th Committee, Jacob’s Deposition, p. 177) He would go on to mention that despite the circumstances, Mike Pence would stay within the Capitol to make sure that “we completed the vote count that day.”(January 6th Committee, Jacob’s Deposition, p. 177-178)

William Stepien would testify that he initially worked with Donald Trump in his 2016 election campaign as a National Field Director, which meant he would help encourage voters to vote for him as president and track what’s going on in terms of what States were leaning which way.(January 6th Committee, Stepien’s Testimony, p. 7) Later on, we would become involved again in 2020 for Trump’s 2020 re-election campaign in mid-July 2020 as a Senior Political Advisor.(January 6th Committee, Stepien’s Testimony, p. 8) Before becoming a campaign manager for Trump, he focused on overseeing the operating of the campaign and outreaching to States, after becoming a campaign manager, his roles would be expanded.(January 6th Committee, Stepien’s Testimony, p. 8) This likely meant Trump respected Stepien or at least felt that he was doing a good job for his campaign.
When the votes for the 2020 United States presidential election in Michigan were starting to go in favor of Joe Biden, he and his campaign staff would become confused as to why Rudy Giuliani was convinced that Trump had in fact won the State, despite them having the most up to date data that most would not be able to see at the moment,(January 6th Committee, Stepien’s Testimony, p. 52-53) to which they would feel that it was likely due to belief rather than data.(January 6th Committee, Stepien’s Testimony, p. 52) In response, Giuliani would show them a map on his tablet of the New York Times election night reporting of Michigan, which did not sway Stepien’s or any other campaign staffs mind that Trump was starting to do poorly.(January 6th Committee, Stepien’s Testimony, p. 54) Giuliani would then say that they should declare victory immediately, despite all the ballots not being counted yet.(January 6th Committee, Stepien’s Testimony, p. 54)
On November 7th, he would claim that Trump’s campaign would begin to receive calls from voters that there might have been foul play at their polling stations, although he does not specify if any of them were confirmed or not,(January 6th Committee, Stepien’s Testimony, p. 76) however he does differentiate “fraud” and “irregularities,” with irregularities not involving dead people or secret ballots.(January 6th Committee, Stepien’s Testimony, p. 81) Once the election was called off, Stepien said that at the time he and his campaign “did not have a basis to believe President Trump won on November 7th.”(January 6th Committee, Stepien’s Testimony, p. 82)
