Biden Border Crisissources needed
Joe Biden could bring back Title 42 from Trump during COVID-19, but that was during a time where there were far fewer people trying to cross the border, with the largest spike in migrants at the border under Trump was half of the average it is now. The expiration of Title 42 has also seemingly had no affect on the amount of migrants attempting to cross the border. This also wouldn’t explain why Barack Obama’s border was more secure than Joe Biden and Donald Trump, since Title 42 did not exist yet.
The exact origin and cause of this migrant crisis seems to be inconclusive, but is most likely caused by several government economies crashing after the fallout of the pandemic.
Joe Biden could also not repeal or overrule any US asylum laws unilaterally without Congress.
The National Security Act put fourth by the Democrats with limited support from Republicans was an effort to help with the border by allocating more resources and money toward it and by giving the President more power to control the border, like closing it, under emergency circumstances. Unfortunately, it was voted down in the Senate by Republicans. Leading reasons for this is that Republicans think Biden already has the resources do handle it and that he can close the border at will, former being arguable and latter being false.
Closing the border, even if Biden could do it, would also disrupt massive amounts of trade, since doing so also blocks legal entry into the country.
It should also be noted that Joe Biden can’t do much about asylum rights in the United States without Congress. In the past, Trump has tried to circumvent asylum laws to better restrict the border, only for those actions to be struck down by the Supreme Court.
Border “Encounters” can also include the same migrant trying to get across multiple times, inflating the number.
Summary
The overall problem with the border goes as follows.
- If a migrant asks for asylum, they cannot be denied entry into the country and must be allowed in, whether that’s under detainment or not. This seems to be the majority of migrants at the border as of 2024.
- If a migrant is denied from entering the country, there is nothing stopping them from trying again at a later time, costing the border patrol even more resources for the same migrants.
- If too many migrants as for asylum or are detained at the border, and if they cannot be deported for the previously mentioned point, then the only option left is to let them inside the country with a NTA (Notice to Appear).
- Creating a physical barrier at the border would not only be one of the most costly projects the United States has ever taken, but it would not be that effective at stopping illegal immigration.** CITATION NEEDED
Potential Solutions
- Greatly expand resources for Border Patrol, including more access to beds and more options for location of detainment.
- Overhaul the immigration system as we know it, greatly reducing the times it takes to get through legal pathways.
